Senem’s LTD Terms & Conditions

 

Please take time to read all these Terms & Conditions.

 

Upon accepting your Order, it becomes a legally enforceable aggreement without furher reference to you. You must read these Terms & Conditions to ensure that all of them are aggreable for you. If you feel unsure about anything, you can call us on 07547 727501.

 

1. Applications

 

We aim to provide our high quality natural handmade olive oil soap products to you in the most efficient way and if you have any concerns regarding your order, we promise to handle with it promptly.

 

The Terms & Conditions here will apply to the purchase of Goods by you (the Customer, or you). We are Senem’s LTD, whose trading name is Senem’s Natural, a company registered in England & Wales under the number of 10844654 whose registered office is at 29, 19 Whytecliffe Road South, Purley, CR8 2EZ with e-mail address info@senemsnatural.com, telephone number 07547 727501 (the Supplier or us or we).

These are the Terms which we sell all the Goods to you. By ordering any of the Goods; you agree to be bound by these Terms & Conditions. You can only purchase the Goods from the Website (“www.senemsnatural.com”), if you are eligible to enter into a contract and are at least 18 years old.

 

2.Interpretations

Consumer means an individual acting for purposes which are wholly or mainly outside his or her trade, business, craft or profession;

Contract means the legally binding agreement between you and us for the supply of the Goods;

Delivery Location means the Supplier’s premises or other location where the Goods are to be supplied, as set out in the order;

Durable Medium means paper or e-mail or any other medium that allows information to be addressed personally to the recipient, enables the recipient to store the information in a way accessible for future reference for a period that is long enough for the purposes of the information, and allows the unchanged reproduction of the information stored;

Goods means the Goods advertised on the Website that we supply to you of the number and description as set out in the Order;

Order means the Customer’s order for the Goods from the Supplier as submitted following the step by step process set out on the Website;

Privacy Policy means the terms which set out how we will deal with confidential and personal information received from you via the Website;

Website means our website www.senemsnatural.com on which the Goods are advertised.

 

3.Goods

The description of the Goods is as set out in the Website, catalogues, leaflets or other form of advertisement. Any description is for illustrative purposes only & there may be small discrepancies in the size & colour of the Goods supplied. All Goods which appear on the Website are subject to availability. We can make changes to the Goods which are necessary to comply with any applicable law or safety requirement. We will notify you of these changes.

 

4.Personal Information

We retain & use all information strictly under the Privacy Policy. We may contact you by using e-mail or any other electronic communication methods and by pre-paid post & you expressly agree to this.

 

5.Sales Contracts

The description of the Goods in our Website does not constitute a contractual offer to sell the Goods. When an order has been submitted to on the Website, we can reject it for any reason, although we will tell you the reason without delay.

The order process is set out on the website with easy to follow steps. Each step allows you to check and amend any errors before submitting the Order (Order Confirmation). You must ensure that the Order Confirmation is complete and accurate and inform us immediately of any errors. We are not responsible for any inaccuracies in the Order placed by you. By placing an Order you agree to us giving confirmation of the Contract by means of an e-mail with all information in it (ie Order Confirmation). You will receive the Order Confirmation within a reasonable time after making the Contract, but in any event not later than the delivery of any Goods supplied under the Contract.

 

6.Secure Ordering and Payment

 

In order to use our website and/or receive our services, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any law or regulation applicable to you. When registering or placing an order to purchase goods on this Website you guarantee that the personal information which you are required to provide is true, accurate and uptodate in all respects. When there are any changes in your personal information, please notify us immediately by contacting us on +44(0)7547727501 (9am to 5pm GMT Monday to Friday) or send an email info@senemsnatural.com for an update. You warrant that you are not impersonating any other person, business or entity or using a false name or a name that you are not authorised to use. When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and delivery fees is available on the payments page.

We put orders from our website (and credit card orders by other means) through Paypal, one of the leading Internet payment service. You place your order request for goods from the Website by clicking on the check out with Paypal button at the end of the on-line order process. You will follow simple instructions available to guide you on the Website through the process of placing an order. You can either login to your Paypal Account to pay or if you do not have a Paypal Account, you can choose Pay with credit/debit card option and proceed as a guest user.

Once you have placed your order, an acknowledgement will be sent to you automatically, providing you with a payment reference and the value of your order which has been debited to your bank or Paypal account, credit/debit card. After making an order on our site, you will be asked to enter your debit/credit card details.  This information is then protected in transit over the Internet by SSL encryption. You may see a completed padlock or key in your browser when you are on the payment page. Long obsolete web browsers (typically version 3 or before) may not make a secure connection or may display an unnecessary security warning because their technology or internal security certificates are out of date.

Payment can be made by any major credit card and will be debited and cleared from your account before the dispatch of your goods. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery. You confirm that the credit or debit card that is being used is yours.

We will retain the legal ownership of the goods until full payment has been made by you and such payment has been received by us. Legal ownership of the goods will immediately revert to us if we refund any such payment to you.

Goods will only be despatched once payment has been received in full.

 

 

7.Delivery

We will deliver the Goods to the Delivery Locations by the time or within the agreed period or, failing any agreement, without undue delay and, in any event, not more than 30 days after the day on which the Contract is entered into. We will make every effort to despatch orders within 5 working days of receipt – saying that, orders are usually sent out within 24 hours using Hermes, but in some cases such as over weekends and bank holidays you order will be shipped next business day. The standard delivery prices listed on the website include a 3-5 day delivery service within the UK mainland. Deliveries outside the UK mainland will be between 7-14 days, depending upon the destination. Deliveries outside of the UK Mainland will incur a surplus delivery cost – please email us for a quote. All international orders will be treated separately. We accept orders and ship to UK and European addresses only. The Hermes will make 3 attemps for delivery for delivery within UK. It is the Customer’s responsibility to ensure that a recipient or representative is present for the delivery. If the delivery is returned to Senem’s LTD, re-delivery will not be possible and the order will be cancelled and Customer will be refunded in full.

Senem’s LTD does not accept any liability whatsoever for delayed delivery caused by any third party. As soon as you have received the goods, you will assume all risk in the goods. Upon delivery of the goods to you, we will also provide you with sufficient details to enable you to:

a) exercise your right of cancellation; and

b) address any intended cancellation or complaints to the correct place of business.

If you have not received the entire order as detailed in the order confirmation email sent to you when an order is received, please contact Senem’s LTD.

 

8.Returns and cancellations

For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (a) Products can be returned only in the country in which they were originally purchased (b) Products that have been already used can not be returned due to hygienic concerns.

Our acceptance of your order and the completion of the contract between you and us will take place when we have dispatched the goods ordered by you. To cancel your order after it has been dispatched to you, you will need to follow the Returns Policy & Procedure.

We may not accept your order if an item you have ordered is out of stock, we are unable to obtain authorisation for your payment or if we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time.

If we are unable to fulfil your order following our order acknowledgement, we will contact you by email or telephone advising you of this.

Right to cancel

Subject as stated in these Terms and Conditions,  you can cancel this contract within 14 days without giving any reason. The cancellation period will expire after 14 days from the day on which you acquire, or a third party, other than the carrier indicated by you, acquires physical possession of the last of the Goods.

To exercise the right to cancel, you must inform us to cancel this Contract by a clear statement setting out your decision (eg a letter sent by post or e-mail). You can use the attached model cancellation form, but it is not obligatory. In any event, you must be able to show clear evidence of when the cancellation was made, so you may decide to use the model cancellation form. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

Effects of cancellation in the cancellation period

Except as set out below, if you cancel this Contract, we will reimburse to you all the payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

Deduction for Goods supplied

We may make a deduction from the reimbursement for loss in value of any Goods supplied, if the loss is the result of unnecessary handling by you (ie handling the Goods beyond what is necessary to establish the nature, characteristics and functioning of the Goods; eg it goes beyond the sort of handling that might be reasonably allowed in a shop). This is because you are liable for that loss and, if that deduction is not made, you must pay us the amount of that loss.

Timing of Reimbursement

If we have not offered to collect the Goods, we will make the reimbursement without undue delay, and not later than:

  1. 14 days after the day we receive bac from you any Goods supplied, or

  2. (if earlier) 14 days after the day you provide evidence that you have sent back the Goods.

If we have offered to collect the Goods or if no Goods were supplied, we will make the reimbursement without undue delay, and not later than 14 days after the day on which we are informed about your decision to cancel this Contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

Returning Goods

If you have received the Goods in connection with the Contract which you have cancelled, you must send back the goods or hand them over to us at 29, 19 Whytecliffe Road South, Purley, CR8 2EZ without delay and in any event not later than 14 days from the day which you communicate to us your cancellation of this Contract.the deadline is met if you send back the Goods before the period of 14 days has expired. You agree that you will have to bear the cost of returning the Goods.

9.Complaints and Customer Service

 

The Customer should inform Senem’s LTD Company immediately of any problems by Telephone +44(0)7547727501, or e-mail to info@senemsnatural.com. If there are any complaints, they by Senem’s LTD Company and will be dealt with within 5 working days.   Please note that the Customer is also welcome to contact Senem’s LTD Company on any issue relating to their order on the contact telephone, or e-mail listed above. Senem’s LTD Company main operating hours are from 9:00 GMT to 5pm GMT, Monday to Friday.

 

10. Account Details and Customer Privacy

 

By using the Website, you agree to keep your password and account details confidential, and to take all reasonable measures to prevent unauthorised access to your account. You are responsible for all actions that occur in relation to your account. If you forget your password we will reset it upon your request and send it to the email address you registered with.

Senem’s LTD Company collects the information provided by the Purchaser at the time of ordering and uses this information lawfully and in accordance with the Data Protection Act 1998. Information is collected by Senem’s LTD Company to process the Purchaser’s order and also to provide the highest level of customer service possible.

Senem’s LTD Company does not sell or pass customer’s e-mail addresses or other details to other parties nor do we bombard our customers with endless e-mails and leaflets. If you order from us, we may contact you about your order and we may, on occasion, e-mail or write to you with information about our products and special offers. If you would prefer not to receive any promotional material at all from us, please let us know.

Your privacy is critical to us. We respect your privacy and comply with the General Data Protection Regulation with regard to your personal information. 11. Pricing

 

Prices for Goods include VAT where applicable as well as standard packaging. The price does not include the delivery of the order to the Purchaser. This is an additional cost, unless otherwise stated. We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the Website are correct at the time when the relevant information was entered onto the system. Although we aim to keep the Website as up to date as possible, the information including product descriptions appearing on this Website at a particular time may not always reflect the position exactly at the moment you place an order.

12. Product and Product Variations

Please bear in mind that our handmade range of products are genuinely hand-made in small volumes so you may encounter some variation in colour, texture, scent or wrapping between batches or orders and as they are pictured on this site or in any other marketing materials. If you do have any problems or queries, please let us know.

We attempt to be as accurate as possible when describing products on the website; however, to the extent permitted by applicable law, we do not warrant that product descriptions, on the Website are accurate, complete, reliable, current, or error-free.

Any products and services, and any samples thereof, we may provide to you are for personal use only. You may not sell or re-sell any of the products or services, and any samples thereof, you receive from us.

 

13. Samples

As we are still a small business in all senses of the word, we are unfortunately unable to supply goods on approval nor are we able to supply free samples of our soaps by post. If you’d like to try our soaps, we recommend that your order just one travel-size bar from this website. This costs less than £11 delivered in the UK and we’re so confident that you will enjoy it. If you are looking to purchase wholesale, of course we will take that initial cost off your first order.

15. FORCE MAJEURE

 

Senem’s LTD Company will exercise every reasonable effort to meet the requested dispatch date. Senem’s LTD Company shall not, however, be liable for any loss or damage due to delays or failure to ship resulting from any cause beyond its reasonable control, such as but not limited to compliance with laws or regulations, acts of God, acts or omissions of the Purchaser, acts of civil or military authority, judicial action, defaults of sub-contractors or suppliers, labour disputes, failure or delays in transportation, embargoehs, wars or riots.

 

16.Jurisdiction and Contact details

 

JURISDICTION: These terms and conditions shall be governed by and construed in accordance with relevant United Kingdom law and the relevant courts of the United Kingdom will have exclusive jurisdiction in relation to the Agreement.

None of the above terms affect your statutory rights as a consumer.
